Current status

Primary-document fact

District agrees to restore nine librarian positions in 2027–28

Agreement announced; future duties in 2027–28 · 2026-10-21

The agreement requires written reinstatement offers to nine former Library Media Specialists by October 21, 2026, with duties resuming on the first day of the 2027–28 school year at the same school and FTE as before the reduction in force. Each has seven calendar days after receiving the offer to accept or decline. Declining or not responding ends the district’s paragraph 2 reinstatement obligation for that librarian. This is future reinstatement, not evidence that the librarians are already back in those roles.

Response / later development

Paragraph 12 makes the agreement subject to board ratification. A separate official ratification vote has not been verified here; the executed agreement and district announcement support the reported commitment, not confirmation of completed implementation.

Attributed news reporting

Hobbs urged librarian cuts and directed a promotion

Reported HR appointment vote; other discussions span 2024–25 · 2024-07-18

The Union-Tribune reports Hobbs urged targeting librarians for cuts, using his own characterization that they were ‘anti-Board.’ That characterization was Hobbs’s, not a verified description of librarians or a quote assigned to every trustee. It also reports Kelly approved Hobbs preparing a directive about Jessica Merschtina’s HR appointment, and Kelly, Woods and Shield voted for that appointment on July 18, 2024.

Response / later development

Superintendent Sandra Huezo said her understanding was that the job had been posted and candidates interviewed, but Merschtina was not among them. This account is not a judicial finding about the appointment. The later librarian agreement requires future 2027–28 reinstatement offers on its stated terms.

Primary-document fact

The 2025 cuts remain part of the record

Reduction in force identified in the agreement; subsequent transfers in August 2025 · 2025-02-27

The district’s October 21 announcement says the 2025 reduction in force eliminated site-based teacher-librarian positions and reassigned affected employees to classroom teaching positions at their respective schools. Eliminating a position is not proof its former occupant lost all district employment.

Response / later development

The district describes the new agreement as future-focused and intended to avoid continuing litigation costs. The reinstatement commitment covers the nine librarian positions, not every position affected by the cuts.

Primary-document fact

PERB settlement does not settle the individual civil claims

Settlement terms, not a trial judgment · 2026-10-21

The agreement provides for withdrawal with prejudice of the union’s PERB charge two days after reinstatement offers. It preserves individual librarians’ civil claims and the district’s defenses. It awards no backpay, damages, penalties or other make-whole relief under this agreement and the PERB proceeding.

Response / later development

The district admits no wrongdoing and denies the allegations in the individual civil lawsuit. The agreement does not establish unlawful retaliation.

Primary-document fact

Employment protection has limits

Future end of protected period, subject to terms · 2029-06-30

From reinstatement through June 30, 2029, the agreement protects reinstated librarians against specified adverse employment actions. Voluntary changes agreed in writing and discipline or dismissal for cause are exceptions. It permits notices in spring 2029 for layoffs taking effect in 2029–30.
